Is an HOA liable for crime in the community in California?
It can be. California courts have held that an association, like a landlord, has a duty to take reasonable steps against crime it knows about or should foresee in common areas. The leading case is Frances T. v. Village Green Owners Association (1986). A board that ignores repeated incidents carries more risk than one that documents what it did.

What can HOA security guards legally do in California?
HOA security guards can observe, report, ask people to leave private property, enforce the association's rules through documentation, and make a private person's arrest under Penal Code 837 for a crime committed in their presence. They are not police. They cannot search people, issue legal citations, or use force beyond what is reasonable for defense.

Can an HOA tow cars from private streets and guest parking in California?
Yes, if it follows Vehicle Code 22658. The association must post signs at least 17 by 22 inches at every entrance with the tow company and police phone numbers, give written authorization for each tow with someone present to verify the violation, and notify police within one hour. Wrongful tows can cost four times the towing and storage charges.

How do we stop car break-ins in our HOA or apartment parking area?
Fix lighting and gates first, because most break-ins happen where it is dark and access is open. Then add patrol at irregular times during the hours the break-ins occur, log every incident by location, and tell residents to leave nothing visible in cars. Cameras help identify patterns but rarely stop a thief on their own.

Does our HOA need a patrol service or a full-time guard?
Most communities under about 200 homes are well served by vehicle patrol visits several times a night. A full-time officer makes sense for a staffed gate, a large community with amenities open late, or an active problem such as nightly trespassing. Patrol typically costs $2,500 to $7,000 a month and a dedicated overnight officer $7,000 to $10,000.

What should an HOA security report include?
Every shift report should show officer name, arrival and departure times, the time of each patrol round, the condition of gates and amenities, any incident with who, what, where and when, the action taken, who was notified, and dated photos. A monthly summary should group incidents by type and location and recommend fixes.

What can a security guard legally do in California?
A California security guard has the same powers as any private person. They can observe and report, ask people to leave private property, and make a private person's arrest under Penal Code 837. Retail guards may detain a suspected shoplifter for a reasonable time under Penal Code 490.5. They cannot act as police, search people, or use unreasonable force.

Should I hire a security guard or an off-duty police officer?
For most businesses, events and communities a licensed security guard is the practical choice at $18 to $55 per hour. Off-duty officers cost considerably more, are arranged through their agency, and have limited availability. They make sense when you need police authority on site, such as traffic control on public streets or a high-risk event.

Choose mobile patrol when the property is closed and you need it checked several times a night at low cost. Choose an on-site guard when people are present, access must be controlled, or incidents are frequent. How do I get trespassers removed from my business property in San Diego?
Post no-trespassing signs, then file a trespass authorization letter, often called a 602 letter or letter of agency, with San Diego Police or the Sheriff. It lets officers remove and arrest trespassers under Penal Code 602 when you are not there. A security officer on site can issue warnings, document repeat offenders and call it in.

Most single-entrance sites need one officer per shift. Add officers for each additional entry that must be staffed, for properties too large to walk in about 30 minutes, and where risk is high enough that an officer should not work alone. A site walk gives the real number, and it is often fewer than owners expect.

A common starting point is one officer for every 75 to 100 guests. Plan more when alcohol is served, the crowd is young, the event is ticketed, or the venue has several entrances or a large parking area. A 150-guest wedding usually needs two officers, and a 500-person concert usually needs five to eight.

How do I check if a security company is licensed in California?
Search the company name or license number at search.dca.ca.gov, the California Department of Consumer Affairs license lookup. A guard company needs a Private Patrol Operator (PPO) license from the Bureau of Security and Investigative Services, and each guard needs a guard card. State law also requires a PPO to carry at least $1,000,000 in general liability insurance.
