4. Service Disclaimer โ€” Security Guard Services

4.1 Risk Reduction, Not Elimination

Security guard services provided by MT Security & Investigations are professional risk-reduction measures. Security officers deter, detect, observe, and report security threats and incidents. The presence of security personnel significantly reduces the likelihood of security incidents at a protected location. However, MT Security & Investigations cannot and does not guarantee the complete prevention of crime, trespass, vandalism, theft, property damage, personal injury, or any other security incident.

4.2 Officer Authority and Conduct

California security officers are private citizens with no greater authority than any private citizen, except as expressly authorized by law or property owner. Security officers may exercise the same rights as a private citizen to make a citizen's arrest under California Penal Code ยง837 when a public offense has been committed or attempted in their presence. Officers are trained to de-escalate situations and to contact law enforcement for situations requiring police authority. Our officers do not have police powers, are not law enforcement officers, and should not be represented as such.

4.3 Use of Force

MT Security & Investigations personnel are trained to use the minimum force necessary to protect life and property in compliance with California law. Any use of force beyond verbal direction is documented in an incident report and reviewed by management. Armed security officers are additionally licensed by BSIS and trained in the safe and lawful use of firearms.

4.4 Incident Documentation

Security officers document incidents through written incident reports. These reports are provided to the client upon request. Incident reports are factual documentation of observed events and do not constitute legal advice, criminal complaints, or admissions of liability.

5. Service Disclaimer โ€” Private Investigation Services

5.1 California Private Investigation Law

All private investigation services are conducted in compliance with California Business and Professions Code Sections 7520 et seq. and all applicable federal and state privacy laws. Private investigators in California are licensed professionals who may lawfully observe activities conducted in public places or in areas visible to the public, conduct recorded interviews with consenting parties, conduct public records research, and perform other investigation activities permitted by law.

5.2 Prohibited Activities

MT Security & Investigations will not conduct any investigation activity that would constitute: illegal wiretapping or electronic surveillance in violation of the California Invasion of Privacy Act (Penal Code ยง630 et seq.); unauthorized access to private records or computer systems in violation of the California Penal Code; surveillance in locations where individuals have a reasonable expectation of privacy without lawful authority; obtaining information through fraud, misrepresentation, or impersonation of a government official; or any activity that violates California or federal law.

5.3 Investigation Results

Investigation findings are provided in written reports based on observations, interviews, and public records research conducted during the engagement. Findings represent what was documented during the engagement period. Investigation reports are provided solely to the client who retained the service. The Company makes no representation that investigation findings are complete, that the subject of an investigation did not engage in undisclosed activities during periods not under surveillance, or that findings will achieve any particular legal outcome. Clients should consult with their attorney regarding the use of investigation findings in any legal proceeding.

5.4 Confidentiality

All client matters, including the identities of clients, subjects of investigations, and investigation findings, are held in strict confidence.
